ARTICLE 1 - GENERAL
These terms of sale of timeless-eyllye.com for the company TIMELESS by EYLLYE (including the TIMELESS by EYLLYE brand for products in general and the EYLLYE brand stamped on the leather goods) define the rights and obligations of the parties in the sale of products by TIMELESS by EYLLYE at Customer and use of timeless-eyllye.com website. The customer declares to have taken note and accepts the rights and obligations relating thereto.
ARTICLE 2 - TERMINOLOGY
The services offered by TIMELESS by EYLLYE on its timeless-eyllye.com website, namely the online sale of products, will hereinafter be referred to as "timeless-eyllye.com services".
Each person wishing to benefit from the services of timeless-eyllye.com and who will comply with the present terms will be called hereafter the customer; Each order made by a customer under the conditions provided herein will be referred to as "the order".
ARTICLE 3 - PRODUCT DESCRIPTION
The products of the company TIMELESS by EYLLYE are made in small quantities, in France. Also, TIMELESS by EYLLYE is engaged to work in ethic and sustainable way by the designs of its models and the follow-up with its suppliers. All raw materials come from the high-end industry, with textile supplies in France and Western Europe. The leathers are sourced from providers recognized by the high-end sector. Exotic leathers have a traceable origin and comply with CITES standards. To support ecology and circular fashion, we optimize our scrap losses during the manufacture of our products. Also, for the realization of certain prototypes or products made in small quantities, we use scraps of leather as well as end of stock of fabrics (purchase in France).
TIMELESS by EYLLYE does not publish a seasonal collections, the products presented on timeless-eyllye.com are listed by category.
"The Wardrobe" includes a set of black textile items (in "Garments" and "Fabric Lab") and leather items (in "Leather Goods"). The products are seasonless and presented on timeless-eyllye.com from one season to the next. The items can, according to their mention, be available on stock, at the customer's request in tailor-made (by entering the requested measurements), or on pre-order.
The “Garments” category is intended for versatile / adaptable fabric items (knitted ir woven). "Versatile" products allow the proposed garment to be worn in several ways. The possibilities and / or variations of a product are indicated, detailed and described on the corresponding product sheets on timeless-eyllye.com. At time, TIMELESS by EYLLYE does not provide video tutorials for "versatile" items, but is committed to making its best efforts to provide the elements necessary for the correct use of the garments.
The “Fabric Lab” category represents items created from innovative or optimized textiles. The TIMELESS by EYLLYE "Anti-Aging" items, presented on timeless-eyllye.com, are representative of a balance between fashion, technology and innovation. The fabric avantage of these garments make it possible to benefit from the anti-aging effects thanks to the hyaluronic acid particles integrated into the fiber. All dermatological efficacy tests and follow-ups were carried out by the suppliers of TIMELESS by EYLLYE. Also, the company TIMELESS by EYLLYE cannot be held responsible for any undesirable effects related to this fabric or this garment range.
"Leather goods" includes the black leather items presented on timeless-eyllye.com, are branded « EYLLYE », and are hand crafted in small quantities, in a traditional way. Each item is unique, in appearance, by it’s texture and imprint specific to each skin. The leathers used to create the leather goods are made from genuine leather. Items may show differences in patterns and / or relief, du to the placements and easthetic of the skin pattern define during cutting of each piece, making it a unique model.
TIMELESS by EYLLYE crafted leather items in timeless colors available individually or in small quantities. The articles thus made from leather scraps are listed in “Limited Edition”.
"L’Ego Play" is representative of a selection of items from "Garments" and "Leather goods". The items in this category are selected for their complementarity and ease of association with other pieces of «The Wardrobe » to increase the product's potential tenfold.
ARTICLE 4 - ORDER TERMS AND PRICES
ARTICLE 4A- GENERAL TERMS
Customers have the possibility of ordering by Internet with www.timeless-eyllye.com
Customers guarantee that they are fully authorized to use the credit card and that this credit card provides access to sufficient funds to cover all costs resulting from the use of the services of timeless-eyllye.com. Only those legally able to enter into contracts for the goods and services offered on the website can order on timeless-eyllye.com.
The data recorded by TIMELESS by EYLLYE are proof of all transactions between TIMELESS by EYLLYE and its customers. TIMELESS by EYLLYE will systematically confirm your order and its shipping by email.
The contractual informations are initially presented in French.
The prices of our products are indicated all taxes included. For deliveries and services outside France, the provisions of the General Tax Code relating to VAT will apply. For any delivery outside the European Union, the customer will be invoiced free of charge, he undertakes to pay the VAT of the country of delivery as well as the customs duties on delivery (Article 262 of the General Code of import / export).
Timeless-eyllye.com reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time of the registration of the orders (subject to availability). Timeless-eyllye.com reserves the right to refuse any order from a customer with whom there is a dispute.
Unless expressly stipulated, timeless-eyllye.com does not give discount.
ARTICLE 4B - SPONSORSHIP PROGRAM - LOYALTY POINTS - REWARDS
TIMELESS by EYLLYE has set up, on its timeless-eyllye.com web site, a sponsorship program and compensation by loyalty points according to the Customer's engagement.
Unless the product is returned, following the validation of his order (validation of payment, delivery of the product), the customer will receive a reward in loyalty points proportional to the amount of his purchase (excluding shipping costs).
The “loyalty points” can be transformed into discount voucher, from the customer's personal account. The customer will be able to accumulate loyalty points throughout his orders on timeless-eyllye.com. Loyalty points are valid for one year from their date of acquisition. After this period, the unused points will be forfeited and cannot be converted into a reduction voucher, or paid back. The loyalty points acquired can be used from the customer's next purchase on the timeless-eyllye.com site, for any order over € 75 (excluding shipping costs). If the amount of the voucher used exceeds the amount of the order, the remainder of the sum of the voucher not used during the order will be lost.
All special conditions relating to loyalty points are mentioned in the customer's personal account in the "My rewards" tab, my account. The customer has access, in his costtumer account, to the history of rewards (accumulated loyalty points) and the history of his reduction vouchers.

After a first validated order, the customer will be able to participate to the sponsorship program set up on timeless-eyllye.com. The "sponsor" can invite friends by email from his « customer account » in the "sponsorship program" tab. The sponsor has a personal code that he can share and which will allow his compensation to be tracked. The sponsor has access to the various conditions and data relating to the sponsorship program in his customer area. When a godchild (invited friend) registers on timeless-eyllye.com, by creating a customer account and indicating the sponsor’s personal code, the sponsorr and his godchild are affiliated for a period of one year.
The Sponsorship program has several levels of rewards, defined according to the status of the referrer. Depending on the involvement and type of partnership with TIMELESS by EYLLYE, the sponsor will receive the rewards relating to the level of the sponsorship program to which he is affiliated. All the conditions relating to the rewards received through the referral program are accessible from "read the conditions" to be validated when inviting potential referrals by email (accessible in "my account", tab "Sponsorship program", tab “Sponsor my friends”).
Any rewards received through the sponsorship program are earned into loyalty points. The sponsor can convert these points into a discount voucher, which can be used under the conditions indicated in his customer account.
ARTICLE 4C - TERMS OF SALE TO PROFESSIONALS
Professionals wishing to acquire products with a view to promoting and / or distributing them, are subject to special conditions and are invited to contact TIMELESS by EYLLYE directly by email at contact(a)timeless-eyllye.com , specifying their request, the products concerned, as well as their telephone number. TIMELESS by EYLLYE will respond to the request as soon as possible in order to establish a suitable offer and to agree a professional contract between the parties.
ARTICLE 5 - AVAILABILITY
Products with stock will be available until the quantities are sold out. Some of these items can be reissued later according to the choice of TIMELESS by EYLLYE and at the period defined by the brand.
Only "Bespoke" products do not have immediate available stock and the product is produced on demand and made-to-measure, when the customer makes an order. Occasionally, TIMELESS by EYLLYE reissues and edit items to pre-order, available according to the period indicated.
“Bespoke” items of TIMELESS by EYLLYE are produced at the customer's request, based on the customer's measurements. For the successful realization of the item, the customer agrees to provide all the measurement information necessary for the successful completion of the order. In order to help the customer in taking a measurement, he can refer to the "measurement guide" on the product sheet of the concerned item. In addition, the composition of the raw materials mentioned for “Bespoke” products may be liable to change / or evolve depending on the availability of fabric stocks. TIMELESS by EYLLYE is committed to using identical textiles in the same spirit, appearance and initial quality. Depending on the time of replenishment of raw materials, the initially scheduled delivery date may be postponed. In both cases, the customer will be notified by e-mail and TIMELESS by EYLLYE will do its best to provide the order as soon as possible.TIMELESS by EYLLYE undertakes to update new information relating to products according to its status.
The items shown in "Pre-order" are made within a more or less long time, depending on the availability of raw materials, the crafting time, as well as the volume of production. According to these criteria, the production period of the products and their availability date may vary. The lead time for a product reference can take a few days or several weeks. Delays related to the production of raw materials by our suppliers and / or the making of our items by our manufacturers, cannot be attributed to TIMELESS by EYLLYE. In the event of a delay in relation to the initially defined availability date, timeless-eyllye.com undertakes to inform the customer by email, and as soon as possible, about the new availability dates of the said product.
Any item available in "Pre-order" has on its product sheet (on timeless-eyllye.com) a countdown indicating the date until which the customer can pre-order the item, as well as the mention of the approximate avaibility date of the product. Following his order, the customer will be notified by email about the different status of the pre-ordered item. As soon as the product becomes available, TIMELESS by EYLLYE will send it to the customer by the means of transport defined by the latter.
The anti-aging clothing in the "Fabric Lab" category is on display on our site, but cannot be purchased directly. For any interest in this range of items, a query should be sent to contact(a)timeless-eyllye.com
Concerning leather items, especially crocodile (Crocodilus Niloticus) and python (Python Reticulatus) items, according to international agreements and CITES issued by the Washington Convention, exports of these products are only open to contries which accept the importation of category IIB species. Also, TIMELESS by EYLLYE reserves the right to cancel the order and delivery of these products to countries by prohibiting importation. In this case, the customer will be notified by email and a refund of the said product will be made.
Timeless-eyllye.com will do its utmost to process all orders.
In case of unavailability of products likely to be in stock when placing the order, the customer will be informed by email or telephone of the delivery of a partial order or the cancellation of his order.
If the debit has already occurred at the time of the information given on the unavailability of a product likely to be in stock, a request for reimbursement of the sums committed on said product is made: an email is then Sent to the customer on this subject. Following this request, the speed with which the bank account is credited depends on the type of customer's credit card.
ARTICLE 6A - INSTANT PAYMENT
Payment of purchases is made by credit card. Credit cards accepted are: CB, Visa, Eurocard and Master Card, and by bank transfer
The order will be considered effective after confirmation of the agreement of the bank payment centers. If the bank refuse, the order will be automatically canceled.

Wire Transfer :
The products remain the property of TIMELESS by EYLLYE until the complete payment of the order at TIMELESS by EYLLYE. However, as soon as the customer receives the order, the risks of the goods delivered are transferred to the customer.
Non-payment: TIMELESS by EYLLYE reserves the right to refuse to make a delivery or to honor an order from a consumer who has not totally or partially settled a previous order or with whom a dispute of payment would be in progress.
Timeless-eyllye.com does not record the customer's bank details, so the customer will have to fill up the fields relating to bank details and payment method for every new order.
ARTICLE 6B - 3 TIME PAYMENT
Pay in 3x free of charge via our partner Clearpay (only for customer how live in France):
When making your purchase, you have the option of paying for a selection of items in 4 times, every 15 days. Timeless by Eyllye does not charge a commission on partial payments when the customer chooses to pay with Clearpay.
Clearpay takes care of the debit modalities when you choose to pay in 3 times. The first part is withdrawn immediately, the 2nd part will be withdrawn 1 month after the purchase, the 3rd part is withdrawn 2 month after the purchase.
Also, Timeless by Eyllye is not responsible for any fees applied by Clearpay to the Customer, if the latter is not up to date in their payments to Clearpay.

ARTICLE 7 - DELIVERY
The products will be sent to the delivery address that the buyer has indicated during the ordering process. For any delivery outside the European Union the customer will have to pay the VAT of the country of delivery as well as the customs duties on delivery (Article 262 of the general code of the import / export).
All our deliveries are announced by email. When shipping a complete order, timeless-eyllye.com warns that an original invoice is available online. In the case of a partial shipment, an order form, available on line, summarizing the products actually present in the package is attached.
TIMELESS by EYLLYE delivers parcels everywhere in Europe and abroad. The customer must choose the place of delivery. In case of absence at the time of delivery, to the address indicated by the customer in Europe, a notice of transit is normally deposited in the mailbox: it is then possible to withdraw the parcel from your post office within 10 Days following the filing of such notice. Deliveries abroad, outside the European Union, will be carried out by carrier (Fedex, UPS, DHL, ...), a tracking number will be made available to the customer, in case of absence, Reprogram the date of delivery, if applicable, the carrier will arrive the next day and the day after the first absence. The delivery time is fixed to 3-5 working days except for special orders such as "Bespoke" production. Delivery times are average delays corresponding to processing and delivery times. Delivery times for "Bespoke" products, created on demand, are 3 weeks as an indication, but may vary according to the delivery time of the raw materials. However, if the stated time limit is exceeded, the customer will be notified by e-mail. These times also vary according to the destination and do not include holidays and weekends.
Each delivery is deemed made as soon as the product is made available to the customer by the carrier, materialized by the control system used by the carrier. It is the responsibility of the consignee to verify the shipments on arrival and to make any reservations and claims which appear justified or even to refuse the parcel if it is likely to have been opened or if it bears obvious traces of deterioration. The said reservations and claims must be addressed to the carrier by registered letter with acknowledgment of receipt within three working days of the delivery of the products, a copy will be sent immediately to TIMELESS by EYLLYE. If a damaged package has been deposited in your mailbox or received by your custodian, the package is considered "accepted as is". If no reservations have been made, we will not be able to take account of any disappearances or to compensate. If the products delivered are not in conformity in kind or in quality with the specifications indicated in the delivery note, you will have to file complaints within 14 days after delivery, otherwise entitlement will lapse.
ARTICLE 8 - TREATMENT OF PACKAGES NOT DISTRIBUTED BY THE PROVIDER

ARTICLE 8B - RETURNS UNDER "NON RECLAIM"
General: These are parcels that have not been claimed by customers at the post office / carrier within the specified time.
Treatment of a return under the "unclaimed" reason: After receipt and acceptance of your parcel by our services, a voucher will be credited to your account within 48 hours of receipt of your parcel.
ARTICLE 8C - RETURNS UNDER THE REASON "REFUSED"

ARTICLE 8D - YOU HAVE REFUSED THE PARCEL AS IT HAD OUTLINED TRACES OF OPENING AND / OR SHOCK.
If the package is damaged, torn, opened ... you must imperatively refuse the package and contact our services to inform us. If the service provider responsible for delivering your package is the Post Office, you must request a declaration of spoliation at the time of the refusal. In the event of a DAMAGE, you must make special reservations on the delivery note. Warning: The words "subject to unpacking" do not constitute a characteristic reserve and have NO LEGAL VALUE. After reception and acceptance of your parcel by our services, depending on the nature of the product, stocks available and according to your wish, we will propose to you to redirect the originally ordered product or an exchange product with equivalent characteristics. Otherwise, a voucher will be credited to your customer account within 48 hours of receipt of your package. It will correspond to the total amount of the order.
ARTICLE 8E - RETURNS UNDER THE GROUND "SPOLIATION"
General: These are parcels that have not been delivered to the customer due to spoliation: open package, traces of shocks, empty packages. ARTICLE 8F - RETURNS FOR REFERENCE ERROR
Return policy: You have 14 days to notify us that the product received is not the ordered product: reference error, size, colour, characteristics, completely different product ... The product must be returned in good condition and in its original packaging, even if the latter has been opened, with all its contents (labels, accessories, cords, etc.). In order to process your request correctly, thank you to remind us your order number and your full contact details.
Processing your return for reference error: After receiving and accepting your parcel by our services, according to the nature of the product, stocks available and according to your wish, we propose you to reship the product initially ordered or another product with equivalent characteristics. Otherwise, a voucher will be credited to your customer account within 48 hours of receipt of your package. It will correspond to the amount of the product (s) returned.
Returns: After receiving and accepting your package, if the postage costs incurred with the Post Office are known by our services, we will automatically issue a voucher for the amount of these costs. If these costs are not known by our services, a proof of the expenses incurred will be requested by our customer service so that the latter can generate the corresponding purchase voucher.
ARTICLE 9 - LOST PACKAGE
When a parcel leaves the premises of TIMELESS by EYLLYE, it is transported by La Poste (for metropolitan France). In the case of a Chronopost consignment or another foreign carrier (Fedex, UPS, DHL, ...) for abroad costumer, the customer is informed of this departure by sending an email informing him of the tracking number. From the time of the deposit of a post office notice in the mailbox of the customer, the one has about 10 days to go to withdraw it to the office of Post; Or if the shipment is abroad, the customer is invited to contact the carrier concerned as soon as possible, following his notice of transit.
If this period is exceeded, the package will be returned to TIMELESS by EYLLYE. However, if 7 working days after the parcel is dispatched, the customer does not have any news of his order, he must approach the closest Post office to the place of delivery indicated on the parcel. If the parcel is found, it is then sent to the customer: the reception procedure then follows its normal course (deposit of the parcel or post office notice, etc.).
If the package is declared lost (the final reply is often made within the maximum time limit of three (3) weeks), timeless-eyllye.com then notifies the customer and immediately commits the refund of the package.
ARTICLE 10 - RETRACTION
In accordance with the French Consumer Code, article L121-20, you benefit from 14 days of retractions on your purchases made on timeless-eyllye.com.
Before any return, the member must indicate his intention by email to contact@timeless-eyllye.com and join his order number of purchase.

The customer exercises his right of retraction in accordance with the article L 121-20 of the French Code of the Consumption within the period of 14 days that starts from the reception of the goods. This right is exercised by the return of the product to TIMELESS by EYLLYE, only the shipping costs remain the responsibility of the customer. The customer can make an exchange with other items, within 14 days from receipt of the goods by TIMELESS by EYLLYE, following the exercise of the right of retraction, if not the refund of the returned items will be made in the form of a credit available in the customer account.
"Bespoke" and made-to-order items are manufactured at the customer's request and produced according to the measurements provided by the customer, the products can not be returned because this is a special order created solely for the client attention.
ARTICLE 11 - GUARANTEE
In the case that a product is not conform to the information given in the presentation of the product on our website, they will be replaced according to the availability of similar products and the wishes of the customer. The delivery of new products will take place within 30 days of receipt of products that do not conform or have hidden defects. TIMELESS by EYLLYE warrants that the products it presents for sale and sell on the website timeless-eyllye.com do not present defects or hidden defects making them dangerous or unfit for their normal use, the contractual guarantee granted by TIMELESS by EYLLYE lasts one year. Any warranty is excluded in the event of defects and damage arising from external events, accidents, wear and tear. The provisions of this article shall not prejudice the legal warranty for latent defects, as defined in articles 1641 et seq. code, when the product is sold to a consumer or a non-professional. Only products with a proven hidden defect may be returned for this reason. According to this article, the customer who declares that his product have a hidden defect must prove it. Thus, an expertise of the product must be requested by the customer with a mandated expert (in his charge) so that it certifies the hidden defect. If the expertise confirms that there is a hidden defect, the document must be sent to our customer service as soon as possible. Upon receipt of the document, a return agreement number as well as the procedure to return your product will be communicated to you by our customer service. ARTICLE 12 - INTELLECTUAL PROPERTY
TIMELESS by EYLLYE and EYLLYE are registered trademarks and covered by rights related to intellectual property as well as copyright. EYLLYE is an original name created in 2014 by Caroline Dodeller and thus subject to copyright, both for the general name and the specific typography in ambigram.
The concept of creation of TIMELESS by EYLLYE models predates the creation of the company in 2016; it was designed and developed by Caroline Dodeller, the fashion designer and founder of the company TIMELESS by EYLLYE, since 2002 and has continued to evolve since. Also all the items prior to the creation of the company TIMELESS by EYLLYE, are protected and come under, also by default, copyright in favor of Caroline Dodeller. No use or misappropriation of the various creations (concept, storytelling, texts, images, videos, items) can be made by a third person, without the agreement of Caroline Dodeller, author and owner of the company and brand TIMELESS by EYLLYE.
Any exploitation, in any way whatsoever, with the aim of studying, imitating or reproducing, the brand (names, appellations), the concept (hyper-adaptability, timelessness, combinations of items), or elements constituting the models (designs, shapes, patterns, materials, supplies, etc.) of TIMELESS by EYLLYE, and consequently of Caroline Dodeller and / or its associates (suppliers, manufacturers, etc.) is prohibited without prior authorization from the concerned parties. TIMELESS by EYLLYE remains the owner of the shapes, volumes and designs developed, as do all the variations (known / unknown) of a product from its range, as well as the new possible associations between the items. That is to say that any creation obtained by transformation, adaptation or association of parts, leads to the obtaining of a new item, by construction and deconstruction. These original creations, made from the basic design of the items (and / or their shape), remain the property of TIMELESS by EYLLYE.
Also, TIMELESS by EYLLYE reserves the right to refuse a sale, in order to protect the company and its designs, against imitations, counterfeits, exploitation for competitive purposes or any other fraud likely to harm the company. However, if a sale were to succeed, and fraud or exploitation of a product for competitive purposes were to be observed a posteriori, the customer who contributed to the dispute, as well as the entity responsible, will be subject to legal action relating to French law.
All texts, comments, books, illustrations and images, whether visual or sound, as well as the labels, the design or patterns of the clothes and accessories, the concept of the brand, reproduced on timeless-eyllye.com are protected under copyright, trademark law, patent law and right to Image, and this for the whole world. They are the full property of TIMELESS by EYLLYE. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private use subject to different or even more restrictive provisions of the intellectual property code is permitted.
