These terms of sale of timeless-eyllye.com for the company TIMELESS by EYLLYE (including its EYLLYE brand, intended for leather bracelets) define the rights and obligations of the parties in the sale of products by TIMELESS by EYLLYE at Customer and use of timeless-eyllye.com website. The customer declares to have taken note and accepts the rights and obligations relating thereto.  

 

ARTICLE 2 - TERMINOLOGY

The services offered by TIMELESS by EYLLYE on its timeless-eyllye.com website, namely the online sale of products, will hereinafter be referred to as "timeless-eyllye.com services".

Each person wishing to benefit from the services of timeless-eyllye.com and who will comply with the present terms will be called hereafter the customer; Each order made by a customer under the conditions provided herein will be referred to as "the order".  

 

ARTICLE 3 - DESCRIPTION OF THE PRODUCTS

The products of TIMELESS by EYLLYE are made in small quantities, in France. Also, TIMELESS by EYLLYE engages in a spirit of ethics, sustainability for its products and follow-up with its suppliers. All the raw materials come from the high-end sector, with a textile supply in France and Western Europe. Leather is supplied to providers recognized by the high-end sector. Exotic leathers are traceable and comply with CITES standards.

The bracelets in leather (category "bracelets") sold by timeless-eyllye.com, labeled EYLLYE, are made in small quantities in an artisanal way and can present irregularities. The leathers used to make the bracelets are made of genuine leather and may have differences in pattern and / or relief placement when cutting from one product to another, making it a unique product in its own right .

The "versatile" products allow the proposed garment to be worn in several ways. The variants and / or alternatives offered by a product are signified, detailed and described on the corresponding product page on timeless-eyllye.com. At the moment, TIMELESS by EYLLYE does not have video tutorials for "versatile" garments, but is committed to making its best efforts to provide the necessary elements for the good use of the clothes.

TIMELESS by EYLLYE's "Anti-Aging" garments on timeless-eyllye.com is representative of a balance between fashion, technology and innovation. The textile characteristic of these garments allows to benefit from the anti-aging effects thanks to the hyaluronic acid nanoparticles integrated directly into the fiber. All dermatological efficacy and follow-up tests were carried out by the suppliers of TIMELESS by EYLLYE. Also, TIMELESS by EYLLYE can not be held responsible for any non-desirable effects related to the textile.

TIMELESS by EYLLYE offers a "bespoke" range with products made to the customer's request. For the correct realization of the garment, the customer undertakes to supply all the information of measurements necessary to the good realization of the order. Also, the composition of raw materials mentioned for "Bespoke" products may be subject to change / or be a little bit different depending on the availability of material stocks. TIMELESS by EYLLYE is committed to using identical textiles in the same spirit, appearance and initial quality. Depending on the time of replenishment of raw materials, the delivery time can be revised upwards. In both cases, the customer will be notified by e-mail and TIMELESS by EYLLYE will do its best to provide the order as soon as possible.

 

ARTICLE 4 - TERMS OF ORDER AND PRICES

Customers have the possibility of ordering by Internet with www.timeless-eyllye.com

Customers guarantee that they are fully authorized to use the credit card and that this credit card provides access to sufficient funds to cover all costs resulting from the use of the services of timeless-eyllye.com. Only those legally able to enter into contracts for the goods and services offered on the website can order on timeless-eyllye.com.

The data recorded by TIMELESS by EYLLYE are proof of all transactions between TIMELESS by EYLLYE and its customers. TIMELESS by EYLLYE will systematically confirm your order and its shipping by email.

The contractual informations are initially presented in French.

The prices of our products are indicated all taxes included. For deliveries and services outside France, the provisions of the General Tax Code relating to VAT will apply. For any delivery outside the European Union, the customer will be invoiced free of charge, he undertakes to pay the VAT of the country of delivery as well as the customs duties on delivery (Article 262 of the General Code of import / export).

Timeless-eyllye.com reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time of the registration of the orders (subject to availability). Timeless-eyllye.com reserves the right to refuse any order from a customer with whom there is a dispute.

ARTICLE 5 - AVAILABILITY

Products with stock will be available until full quantities are sold. Some of these products may be reissued at a later date depending on the choice of TIMELESS by EYLLYE and the period defined by the brand. Only "Bespoke" products do not have immediate stock availability and the realization of the product is made on demand when ordering by the customer.

For leather products, especially crocodile (Crocodilus Niloticus) and python (Python Reticulatus) bracelets, according to international agreements and CITES issued by the Washington Convention, exports of these products are only open to contries which accept the importation of category IIB species. Also, TIMELESS by EYLLYE reserves the right to cancel the order and delivery of these products to countries by prohibiting importation. In this case, the customer will be notified by email and a refund of the said product will be made.

Timeless-eyllye.com will do its utmost to process all orders.

In case of unavailability of products likely to be in stock when placing the order, the customer will be informed by email or telephone of the delivery of a partial order or the cancellation of his order.

If the debit has already occurred at the time of the information given on the unavailability of a product likely to be in stock, a request for reimbursement of the sums committed on said product is made: an email is then Sent to the customer on this subject. Following this request, the speed with which the bank account is credited depends on the type of customer's credit card.

 

ARTICLE 6 - PAYMENT

Payment of purchases is made by credit card. Credit cards accepted are: CB, Visa, Eurocard and Master Card, and by bank transfer

The order will be considered effective after confirmation of the agreement of the bank payment centers. If the bank refuse, the order will be automatically canceled.

Payment terms :

By credit card: Payment is made on the secured banking server of our banking partner.

Wire Transfer :

The products remain the property of TIMELESS by EYLLYE until the complete payment of the order at TIMELESS by EYLLYE. However, as soon as the customer receives the order, the risks of the goods delivered are transferred to the customer.

Non-payment: TIMELESS by EYLLYE reserves the right to refuse to make a delivery or to honor an order from a consumer who has not totally or partially settled a previous order or with whom a dispute of payment would be in progress.

Timeless-eyllye.com does not record the customer's bank details, so the customer will have to fill up the fields relating to bank details and payment method for every new order.  

 

ARTICLE 7 - DELIVERY

The products will be sent to the delivery address that the buyer has indicated during the ordering process. For any delivery outside the European Union the customer will have to pay the VAT of the country of delivery as well as the customs duties on delivery (Article 262 of the general code of the import / export).

All our deliveries are announced by email. When shipping a complete order, timeless-eyllye.com warns that an original invoice is available online. In the case of a partial shipment, an order form, available on line, summarizing the products actually present in the package is attached.

TIMELESS by EYLLYE delivers parcels everywhere in Europe and abroad. The customer must choose the place of delivery. In case of absence at the time of delivery, to the address indicated by the customer in Europe, a notice of transit is normally deposited in the mailbox: it is then possible to withdraw the parcel from your post office within 10 Days following the filing of such notice. Deliveries abroad, outside the European Union, will be carried out by carrier (Fedex, UPS, DHL, ...), a tracking number will be made available to the customer, in case of absence, Reprogram the date of delivery, if applicable, the carrier will arrive the next day and the day after the first absence. Each delivery is deemed made as soon as the product is made available to the customer by the carrier, materialized by the control system used by the carrier. It is the responsibility of the consignee to verify the shipments on arrival and to make any reservations and claims which appear justified or even to refuse the parcel if it is likely to have been opened or if it bears obvious traces of deterioration. The said reservations and claims must be addressed to the carrier by registered letter with acknowledgment of receipt within three working days of the delivery of the products, a copy will be sent immediately to TIMELESS by EYLLYE. If a damaged package has been deposited in your mailbox or received by your custodian, the package is considered "accepted as is". If no reservations have been made, we will not be able to take account of any disappearances or to compensate. If the products delivered are not in conformity in kind or in quality with the specifications indicated in the delivery note, you will have to file complaints within 30 days after delivery, otherwise entitlement will lapse.

 

ARTICLE 8 - TREATMENT OF PACKAGES NOT DISTRIBUTED BY THE PROVIDER

It is the parcels that have not been delivered to the final recipient for the following reasons: IASP, unclaimed, refused, damage to transport, spoliation ...

 

ARTICLE 8A - RETURNS UNDER IASP or RTS

General: These are the parcels returned by the service provider responsible for the delivery under the mention: "Insufficient address", "Live not at the indicated Address", "Undeliverable as Addressed", "Attempted Not Known", "Insufficient Address,".

Processing an IASP/RTS Return:

After reception and acceptance of your parcel by our services, according to the nature of the product, stocks availability and according to your wish, we propose to you to redirect the originally ordered product. Otherwise, a voucher will be credited to your customer account within 48 hours of receipt of your package by TIMELESS by EYLLYE.

 

ARTICLE 8B - RETURNS UNDER "NON RECLAIM"

General: These are parcels that have not been claimed by customers at the post office / carrier within the specified time.

Treatment of a return under the "unclaimed" reason: After receipt and acceptance of your parcel by our services, a voucher will be credited to your account within 48 hours of receipt of your parcel.

 

ARTICLE 8C - RETURNS UNDER THE REASON "REFUSED"

ARTICLE 8D - YOU HAVE REFUSED THE PARCEL AS IT HAD OUTLINED TRACES OF OPENING AND / OR SHOCK.

If the package is damaged, torn, opened ... you must imperatively refuse the package and contact our services to inform us. If the service provider responsible for delivering your package is the Post Office, you must request a declaration of spoliation at the time of the refusal. Please note: The verification of the status of your product is deemed to have been carried out once the delivery note has been signed. Therefore, NO COMPLAINT WILL BE ADMISSIBLE IN THE EVENT OF FAILURE TO COMPLY WITH THE ABOVE INDICATIONS. (Article L.133-3 of the French Commercial Code). After reception and acceptance of your parcel by our services, depending on the nature of the product, stocks available and according to your wish, we will propose to you to redirect the originally ordered product or an exchange product with equivalent characteristics. Otherwise, a voucher will be credited to your customer account within 48 hours of receipt of your package. It will correspond to the total amount of the order.

 

ARTICLE 8E - RETURNS UNDER THE GROUND "SPOLIATION"

General: These are parcels that have not been delivered to the customer due to spoliation: open package, traces of shocks, empty packages. ARTICLE 8F - RETURNS FOR REFERENCE ERROR

Return policy: You have 14 days to notify us that the product received is not the ordered product: reference error, size, colour, characteristics, completely different product ... The product must be returned in good condition and in its original packaging, even if the latter has been opened, with all its contents (labels, accessories, cords, etc.). Otherwise, a voucher will be credited to your customer account within 48 hours of receipt of your package. It will correspond to the amount of the product (s) returned.

Returns: After receiving and accepting your package, if the postage costs incurred with the Post Office are known by our services, we will automatically issue a voucher for the amount of these costs. If these costs are not known by our services, a proof of the expenses incurred will be requested by our customer service so that the latter can generate the corresponding purchase voucher.  

 

ARTICLE 9 - LOST PACKAGE

When a parcel leaves the premises of TIMELESS by EYLLYE, it is transported by La Poste (for metropolitan France). In the case of a Chronopost consignment or another foreign carrier (Fedex, UPS, DHL, ...) for abroad costumer, the customer is informed of this departure by sending an email informing him of the tracking number. From the time of the deposit of a post office notice in the mailbox of the customer, the one has about 10 days to go to withdraw it to the office of Post; Or if the shipment is abroad, the customer is invited to contact the carrier concerned as soon as possible, following his notice of transit.

If this period is exceeded, the package will be returned to TIMELESS by EYLLYE. However, if 7 working days after the parcel is dispatched, the customer does not have any news of his order, he must approach the closest Post office to the place of delivery indicated on the parcel. If the parcel is found, it is then sent to the customer: the reception procedure then follows its normal course (deposit of the parcel or post office notice, etc.).

If the package is declared lost (the final reply is often made within the maximum time limit of three (3) weeks), timeless-eyllye.com then notifies the customer and immediately commits the refund of the package.

 

ARTICLE 10 - RETRACTION

In accordance with the French Consumer Code, article L121-20, you benefit from 7 days of retractions on your purchases made on timeless-eyllye.com.

This right is exercised by the return of the product to TIMELESS by EYLLYE, only the postage costs remain the responsibility of the customer. The refund in the form of a credit will be made on the customer account, failing to make an exchange with another product, will be made within 30 days from receipt of the goods by TIMELESS by EYLLYE, following the exercise of the right of retraction.

"Bespoke" products are manufactured at the customer's request and produced according to the measurements provided by the customer, the products can not be returned because this is a special order created solely for the client attention.  

 

ARTICLE 11 - GUARANTEE

In the case that a product is not conform to the information given in the presentation of the product on our website, they will be replaced according to the availability of similar products and the wishes of the customer. The delivery of new products will take place within 30 days of receipt of products that do not conform or have hidden defects. TIMELESS by EYLLYE warrants that the products it presents for sale and sell on the website timeless-eyllye.com do not present defects or hidden defects making them dangerous or unfit for their normal use, the contractual guarantee granted by TIMELESS by EYLLYE lasts one year. Any warranty is excluded in the event of defects and damage arising from external events, accidents, wear and tear.
